The Licensing Act is the latest set of regulations to come under the scrutiny of the Government’s “red tape challenge”.

The Department of Culture, Media and Sport has begun a public consultation seeking views on whether Section One of the Act should be reformed. This is the section that covers regulated entertainment.

It has often been criticised for burdening small concerts and events with unnecessary red tape.

The Government is now proposing to reconsider the activities currently classed as “regulated entertainment”.

The consultation seeks views on “the removal in certain circumstances of the requirement for a licence in England and Wales to host a performance of a play, an exhibition of a film, an indoor sporting event, a performance of live music, any playing of recorded music, or a performance of dance”.

The consultation runs until 3rd December. We shall keep clients informed of developments.
